Moderatos ("the Service") is a web-based application that provides real-time analysis of group conversations during meetings and calls. The Service captures audio via your browser or our Chrome extension, transcribes it using automated speech recognition, and applies artificial intelligence to analyze group dynamics, speaker participation, and conversational patterns. The Service is designed to help facilitators, team leads, and meeting organizers improve the quality and inclusivity of their group discussions.
To use the Service, you must create an account through our authentication provider, Clerk. You agree to provide accurate and complete information during registration and to keep your account credentials secure.
You must be at least 18 years of age to use this Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
You are responsible for all activity that occurs under your account. If you suspect unauthorized access to your account, you must notify us immediately at support@moderatos.app.
You agree to use the Service only for lawful purposes and in accordance with these Terms. In particular, you agree to the following:
Audio captured through the Service (either via browser microphone access or through our Chrome extension) is streamed in real-time to Amazon Web Services (AWS) Transcribe for speech-to-text conversion. Audio data is processed as a transient stream and is not stored on our servers or in any persistent storage.
The text transcripts generated from the audio stream are stored in our database and associated with your account. These transcripts, along with AI-generated analysis results (such as group dynamics assessments and facilitator suggestions), are retained as part of your session history.
You may request deletion of your transcripts and analysis data at any time by contacting us (see Section 8).
Certain features of the Service may require a paid subscription. All payments are processed by our designated payment processor, which acts as the Merchant of Record for all transactions. The payment processor is responsible for handling billing, invoicing, sales tax, and refund processing.
By purchasing a subscription, you agree to the payment processor's terms of service and privacy policy, which will be presented to you at the time of purchase. Refund requests should be directed to our support team at support@moderatos.app.
We reserve the right to change subscription pricing with at least 30 days' advance notice. Price changes will not affect your current billing period.
The Service, including its design, code, algorithms, and branding, is owned by Moderatos and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
You retain full ownership of your content, including your meeting transcripts, uploaded data, and any materials you create using the Service. We do not claim any ownership rights over your content. We may use anonymized, aggregated usage data to improve the Service, but we will never sell or share identifiable user content with third parties for their own purposes.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
AI-generated analysis, suggestions, and group dynamics assessments are provided for informational purposes only. They do not constitute professional facilitation advice, psychological evaluations, or expert opinions. You should exercise your own judgment when acting on any information provided by the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI CALL MODERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You may terminate your account at any time by contacting us at support@moderatos.app. We may suspend or terminate your access to the Service at any time if you violate these Terms, or for any other reason with reasonable notice.
Upon termination, your right to use the Service ceases immediately. We will delete your account data, including transcripts and analysis results, within 30 days of account termination, unless retention is required by law. You may request an export of your data prior to termination.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.
